BerryBroCreations ("we", "us", "our") respects your privacy. This policy explains what personal information we collect, why, and how we handle it.

What we collect

• Order information — your name, email, shipping address, and the items you order. Payment card details are entered directly into our payment processor (Stripe) and are never seen or stored by us.
• Email sign-ups — if you join our list, we store your email address (and name, if provided) to send updates and offers.
• Usage data — basic, anonymous analytics about how visitors use the site (pages viewed, general location, device type) to help us improve it.

How we use it

• To process, make, and ship your orders and provide customer support.
• To send order confirmations and shipping updates.
• To send marketing emails only if you opted in — you can unsubscribe at any time using the link in every email.
• To understand and improve our website and products.

Who we share it with

We do not sell your personal information. We share it only with the trusted service providers we need to run the shop: Stripe (payment processing), MailerLite (email), Netlify (website hosting), Canada Post and other carriers (shipping), and analytics providers. Each handles your data under their own privacy terms.

Cookies

We use a small number of cookies and similar technologies for essential site functions (like remembering your cart) and anonymous analytics. You can block cookies in your browser settings, though some features may not work as well.

Your choices

You may ask us to access, correct, or delete the personal information we hold about you, or unsubscribe from emails, at any time — just email JonathanM@berrybrocreations.com.

Terms of Sale

By placing an order with BerryBroCreations, you confirm that you are at least 18 years old or have the involvement of a parent or legal guardian, and agree to these Terms of Sale, the Product Safety instructions, the Returns & Refunds policy, and the Privacy Policy shown on this page.

• Made to order. Almost every item is 3D printed by hand after you order it. Typical production time is 2–5 business days before your order ships.
• Prices & currency. All prices are in Canadian dollars (CAD). Shipping is calculated at checkout based on destination and size.
• Order acceptance. Your order is an offer to buy. We may accept or, in rare cases (such as an obvious pricing error or an item we can't fulfil), decline and fully refund it.
• Handmade variation. Layer lines, seams, support marks, minor colour variation, and small dimensional differences are normal characteristics of 3D-printed goods and are not defects unless they materially affect the stated function or make the product unsafe.
• Photos & measurements. Screens display colour differently and listing photographs may show props that are not included. Dimensions and weights identified as approximate may vary slightly. The written product description and your approved custom-order details control.
• Custom orders. Personalized or custom pieces are made specifically for you. Once production has begun, custom orders are non-refundable except where the item arrives damaged, defective, or materially different from what was agreed.
• Shipping & delivery. Delivery estimates are provided in good faith but are not guaranteed because transit is handled by third-party carriers. Title, risk of loss, and the parties' remedies are governed by applicable law. Contact us promptly about a missing or damaged shipment so we can assist with the carrier claim.
• Right to refuse unsafe or unlawful requests. We may refuse or cancel any customization, intended use, destination, or order that we reasonably believe is unsafe, unlawful, infringing, technically unsuitable, or inconsistent with these terms.

Returns & Refunds

Because our items are handmade to order, they are not returnable simply for a change of mind. However, your satisfaction matters:

• If your order arrives damaged, defective, or not as described, contact us within 14 days of delivery with a photo and we will arrange a replacement or refund.
• Custom and personalized items can only be refunded if they arrive damaged, defective, or materially different from what was agreed.

Product Safety & Required Use Instructions

All products

• Heat and flame: PLA plastic can soften, deform, melt, or ignite when exposed to excessive heat or flame. Keep products out of hot vehicles and away from candles, open flame, fireplaces, radiators, heaters, stovetops, ovens, dishwashers, microwaves, high-wattage bulbs, and prolonged direct sunlight.
• Decorative use: Products are decorative or novelty items unless a listing expressly identifies a specific function. They are not safety equipment, protective equipment, medical devices, structural components, load-bearing hardware, climbing equipment, or certified toys.
• Children, pets, and small parts: Products may contain small, pointed, magnetic, battery-powered, or breakable parts that can create choking, ingestion, pinching, or cut hazards. Keep away from babies, young children, and pets. Adult supervision does not make a product a toy.
• Food and water: Products are not food-safe, dishwasher-safe, microwave-safe, or intended for direct food contact unless the listing expressly says otherwise. Printed vases and containers may not be watertight; use a separate liner where appropriate.
• Coasters, holders, and organizers: Use only on a stable surface and only for light household objects within the product's obvious capacity. Do not use a cracked, warped, or loose holder.
• Sports and training accessories: Inspect before every use. They are recreational aids, not protective equipment or substitutes for professional instruction. Use in a clear area and discontinue use after any crack, impact damage, or deformation.
• Replica props: Replicas are display pieces, not weapons. Do not sharpen, strike, throw, brandish, carry in public, or use them to threaten any person. You are responsible for complying with local laws and venue rules.

Lighting, LED, battery & electrical items

• Use only the supplied or manufacturer-specified removable low-voltage or battery-operated light source, cable, controller, and power supply. Any power component used where approval is required must bear a recognized Canadian approval mark. Never connect a product directly to household wiring.
• Never use an incandescent bulb, halogen bulb, heat lamp, open flame, candle, heating element, higher-voltage supply, higher-wattage source, or substituted component in or near a 3D-printed enclosure.
• Place lighting on a hard, level, stable, non-flammable surface with ventilation. Keep it uncovered and away from water, bathrooms, sinks, bedding, curtains, paper, upholstery, solvents, aerosols, and other combustible materials.
• Do not operate lighting unattended, while sleeping, or when nobody is home. Switch off and disconnect power before cleaning, moving, inspecting, or changing a component.
• Do not modify, splice, pinch, tightly bend, conceal, open, or repair any wiring, battery compartment, controller, LED module, connector, or power component. Do not use a damaged, loose, recalled, wet, or unusually warm component.
• If a light flickers, sparks, smokes, crackles, overheats, repeatedly shuts off, smells unusual, becomes discoloured, or has a damaged cable or enclosure, switch it off and disconnect it only if safe to do so. Move away from the area, contact emergency services for smoke or fire, and do not use the product again.
• Remote controls, coin cells, and other batteries can cause serious injury if swallowed. Secure battery compartments and keep all batteries away from children and pets. Follow the battery manufacturer's instructions and local disposal requirements.

Report a malfunction, injury, near miss, or property damage

Stop using the product, keep it and its components in their post-incident condition, take photographs if safe, and contact JonathanM@berrybrocreations.com promptly with your order number and a description of what happened. Do not discard, repair, or alter the product unless needed to prevent immediate harm. We may provide a warning, replacement, refund, stop-use notice, corrective action, or recall where appropriate, and may have legal reporting obligations. For an immediate danger, fire, injury, or medical emergency, contact 911 or the appropriate emergency service first.

Warranty Disclaimer, Liability & Legal Terms

Statutory rights come first

Nothing in these terms excludes, restricts, or waives any condition, warranty, remedy, duty, or liability that cannot lawfully be excluded under the laws that apply to your purchase. Consumer-protection and product-safety obligations continue to apply despite these terms.

Limited warranties and handmade characteristics

Except for express promises in the applicable listing and warranties or conditions imposed by law, products and the website are provided on an "as available" basis. To the fullest extent permitted by law, we disclaim other representations or warranties, whether express, implied, statutory, or collateral, including those arising from a use outside the product's description or from an unauthorized modification. Normal handmade variations described in the Terms of Sale are not manufacturing defects.

Assumption of risk and buyer responsibility

You are responsible for selecting a product suitable for your intended use, reading the listing and safety information before use, inspecting it, using it only as intended, providing age-appropriate supervision, complying with applicable laws, and stopping use when damage or abnormal operation appears. You assume risks created by misuse, use contrary to warnings, unauthorized repairs or modifications, use of incompatible components, failure to supervise, or continued use after a defect or warning becomes apparent.

Limitation of liability

To the fullest extent permitted by applicable law, BerryBroCreations and its owner will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, loss of profits, loss of data, loss of use, or business interruption arising from the website, a delayed shipment, or a product. To the fullest extent permitted by law, aggregate liability arising from a product or order will not exceed the amount paid for the product giving rise to the claim.

The exclusions and cap above do not apply to the extent prohibited by law, including liability that cannot be excluded for fraud, wilful misconduct, gross negligence, death or personal injury, defective or unsafe products, breach of a non-waivable statutory duty, or a consumer remedy preserved by applicable law.

Third-party components and services

Some products may use removable third-party components such as LED modules, puck lights, batteries, remotes, cables, adapters, or power supplies. Those components must be used according to their own labels and manufacturer instructions. Stripe, carriers, email providers, and other third-party services operate under their own terms. Nothing here reduces our responsibilities for components or services where the law makes us responsible.

Indemnity for unlawful or unauthorized conduct

To the fullest extent permitted by law, you agree to indemnify BerryBroCreations and its owner against third-party claims, losses, and reasonable costs to the extent caused by your unlawful use, unauthorized commercial resale, material alteration, combination with an incompatible component, breach of these terms, or violation of another person's rights. This does not apply to the extent a claim was caused by our negligence, misconduct, unsafe product, or breach of law.

Service interruptions and events beyond reasonable control

We are not responsible for delay caused by events beyond our reasonable control, including carrier disruption, severe weather, labour disruption, supply shortage, platform outage, government action, or emergency. This clause does not excuse obligations that applicable law requires us to perform.

Governing law, severability, and entire agreement

These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without depriving a consumer of mandatory protections available in the consumer's home jurisdiction. Subject to those protections, disputes may be brought before courts with jurisdiction in Ontario. If any provision is found invalid or unenforceable, it will be limited or severed only to the minimum extent necessary and the remaining provisions will continue. These terms, the applicable product listing, and any written custom-order approval form the agreement concerning the order.

Intellectual Property

The BerryBroCreations name, logo, website content, photographs, and original designs are the property of BerryBroCreations and may not be copied or reused without permission.

Some pieces are inspired by popular characters and themes and are offered as handmade fan tributes. BerryBroCreations is an independent maker and is not affiliated with, endorsed by, licensed by, or sponsored by any brand, studio, franchise, or rights holder referenced on this site. All third-party names, characters, and trademarks belong to their respective owners.
